It's all about assessment.

This is what Newman calls "working under the lash."

"How can I fight with a chain on my arm? It is like the Persians driven to fight under the lash."

The mentality of assessment:

"If we cannot prove it, it did not happen."

It is a Napoleonic system. We are presumed to be guilty until we prove that we are innocent.
